General Terms of Use

General

• Galeriadelsur.net is an on-line art gallery, in which art works are presented and possibly offered for sale.
• The sales contract is closed directly between the buyer and the respective artist as a salesman.
• Galeriadelsur.net is not responsible for the fulfilment of the closed sales contracts mediated through the website of Galeriadelsur.net.
• The contracting parties hall be responsible for the regulation of payment and delivery.
• In Galeriadelsur.net publish pictures are photographies/scans of the originals. Small color deviations of original are possible due to the digitalisation.
• All illustrations of the works of art, diagrams or texts are subordinate to the copyright of the respective artist. For their duplication or use the written agreement of the author is necessary.
• The operator of Galeriadelsur.net does not take over guarantee for the completeness, up-to-dateness, correctness and quality of the information provided by the artist.
• Galeriadelsur.net is not responsible for contents provided by the customer. The operator has no obligation to check the contents and dissociates himself hereby expressly from all contents of all directly and indirectly linked sides.

Addition for Artists

• The contract running time of a use contract between the artist and Galeriadelsur.net can be 3 months, 6 months or 1 year. The contract time can be selected by the artist at contracting. The period can be changed by the artist at anytime 2 weeks before the contracting period terminates.
• The contract can be ceased at any time minimum 2 weeks notice before expiration of the contract period. Your entry within the Galeriadelsur.net will be deleted at the end of the contract period.
• If no notice of contract termination is expressed, the contract extends automatically for the selected period.
• The operator Galeriadelsur.net reserves itself the right of an extraordinary cancelation of the contract, in case of violation of the law by the customer.
• The artist commits himself to publish his content of his web pages in all three languages (English, Spanish, German).
• An invoice about the agreed services Galeriadelsur.net will make out in EURO with VAT included.
• For the basic charge the invoice will be issued in advance.
• We can first start with the creation of your presentation, after receiving all information and after receiving the deposit.
• The artist does not commit himself to offend with contents of his web pages against legal prohibitions or good customs.

Data protection and security

• Private data conveyed to us serve to carry out exclusively the orders ad inquiries of the client. The data are stored and can be changed or deleted whenever our customers request it.
• All our staff commit themselves to keep discretion.
• ProAspecto S.L. commits itself not to transmit the customer's data to third.
• To use the data of our customers for our own advertising purposes, ProAspecto S.L. have to their explicit consent.

Salvatori clause

• The individual regulations of the present treaty should be or become ineffective, but this does not affect the validity of the remaining ones in it. The parties commit themselves to replace ineffective regulations by new ones in which the regulations contained in the ineffective regulations are to be fair in a legally permissible way. The same applies to regulation gaps in the contract. To fill in those gaps the parties commit themselves to get to an agreement that, coming next, the parties would have determined according to the sense and aim of the contract, in case that this point had been considered by them.
